To his credit, Pence has asked to have Gohmert's suit dismissed.

True, but his argument is that he isn't the right defendant for the suit, not about any constitutional issue with what the suit alleges, although according to news sources, he did reportedly disagree with Gohmert on attempting to overturn electoral votes before the suit was filed.
