As presently constituted, with a 6-3 conservative majority -- and particularly if Republicans lose the election in a week by as much as they are predicted to -- SCOTUS is democratically illegitimate.
For awhile SCOTUS hung on as a relatively well-trusted and non-partisan branch of government, but Bush v. Gore was the first sign of trouble and 20 years later, McConnell has totally wrecked that.
Over the next few years, I predict a rebalancing toward and resurgence in the authority of Congress, which is kind of what our Founders intended anyway.
Both the Presidency and SCOTUS have become dangerously empowered thanks to congressional deadlock and inaction, but I think Schumer and Pelosi are getting ready to move.
Equally important as the Presidency, control of the Senate must flip to Democrats in order to reinvigorate our democracy and reverse creeping minority rule.
