You are mistaking "intelligence" with "cunning" - because if he had been intelligent, he had blown off his ambitions on becoming POTUS in 1990 and restricting his business activites to a small hot dog stand across the Congress after squandering the money of his daddy away.
"Cunning" brought him into the White House, but if he would be "intelligent", he would forfeit his second term on the spot and make plans for negotiations with the various jurisdictions as to reduce the expected jail time as much as possible.
4 years more do only make the difference in being 4 years older when he gets incarcerated.
