No. If someone's case doesn't even go as far as investigation or prosecution, then they are exonerated. If they are investigated but not prosecuted, then they are exonerated. If they are investigated and prosecuted and found not guilty, then they are exonerated.
They are only "not exonerated" if they are found guilty.

Simply by deciding to not investigate.
