actually, most undocumented immigrants that live in the US came here legally though a port of entry and just overstayed their visas.

Yes, it is a crime - and the punishment is deportation.

8 U.S.C. 1227 (a)(1)(C)(i)

Nonimmigrant status violators.-Any alien who was admitted as a nonimmigrant and who has failed to maintain the nonimmigrant status in which the alien was admitted or to which it was changed under section 248 , or to comply with the conditions of any such status, is deportable.

Nothing in that section makes it a crime. In fact crime is mentioned down a bit farther as a separate reason for deportation.

The subsection specifically contains the word "violators". Would you care to look up that word for the rest of the class?

Violator: a person who breaks or fails to comply with a rule or formal agreement.
Still doesn't mean make a visa overstay a criminal act.

You realize that U.S.C. is LAW right? Anything codified within it is LAW. If they're designated as a violator, they're violating the LAW. Anything in opposition to the LAW is ILLEGAL. If it is ILLEGAL it is a CRIME.

It's not a rule, it's THE LAW.

Civil infraction are covered by the law, but they are also not crimes in and of themselves. And the laws also cover things life the flag code, which violating is not criminal to violate.

Flag code doesn't carry a penalty, but the immigration law does.

Immediate deportation
If you overstay for greater than 180 days but less than 1 year, you're barred from re-entry for 3 years
If you overstay for greater than a year, you're barred from reentry for 10 years
