Racial segregation of schools, fountains, restaurants, cafes and theaters differed by state. by 1952-1953, Some states had completely banned it within their own jurisdictions. Others, like the Southeastern states and Texas, required most, if not all public areas to be segregated as with public schools. Still ofthers, such as Kansas, New Mexico, and Arizona, did not require it at all, but did overtly allow such practices.

I'm just saying that laws on race-based segregation by the late 1940s-early 1950s were clearly not uniform all across the country. Also, I wonder if Ms. Topeka Brown ever thought "maybe I could home school my children instead of causing trouble for the folks at the nearby white school"?
