It is fairly complicated, but if I understood it correctly, he was arguing that a confirmation vote not take place until the election campaign is over to avoid over-politicizing a president's choice. He was not saying that a confirmation vote will not even occur until the next president is in office. In any case, if you don't believe him and think that the true intent was delay the vote until a new government was in place, no precedent was actually set since no supreme court opening occurred.
