You think it was scrapped, but the "premises" behind it did not in the government's eyes diminish, but in fact expanded, which is reason to posit it simply moved off-books instead. See, people like you greenly assume you live under the rule of law, when the unacknowledged reality is after 9-11 (the Patriot Act was drafted just before it, not after, and no one was allowed to read it before voting) that effectively 8 out of 10 provisions of the Bill of Rights, to say nothing of habeas corpus, are in de facto legal suspension. Was it announced? No. Front page of the Washington Post or New York Times or CNN? No. Why bother - the public has no right to know.
I'd almost guarantee that someone like you has NO clue that the NSA is - legally!!! - judicially exempted from any statute that does not explicitly identify it to the contrary by name. And you, like most people, assume that if some major legal structural distortion were different, you and everyone could not NOT know about it.
