If we're talking about early fetuses (nobody will tell you that a late stage conscious fetus isn't human) it's because they contain human stem cells that reproduce indefinitely and that we are learning how to specialize to different functions, those cells just haven't specialized yet in a fetus so they have no function and the fetus probably isn't conscious.
