We need to find a misdemeanor law from the 1800's we can magically change to a felony so we can prosecute this behavior. All we need is a few DOJ attorneys to quit their high paying jobs and go to NY with a huge pay cut to prosecute him. You know, to prevent to appearance of Lawfare.
