It sounds like it was a justifiable shooting to me. If you're a cop, you're supposed to yell "Gun!" if the person you're arresting or subuding has a gun to alert other officers. And you're justified in shooting the person if the person points/waves the gun at you or if the person says he'll/she'll shoot you. But what if the person points the gun at another officer or an innocent bystander, or says he'll/she'll shoot another officer or innocent bystander? Are you forbidden from shooting in that instance?
Long story short, that guy needed to die.
