Can the Congress and President vote to authorize murder (extrajudicial killings) and violations of the laws of war?
No. These things they cannot do, lest they violate the rights of due process, of the accused. Rulemaking (the law you cite, if it were actually justifying the things you think it's justifying - the violent and unheralded attacks that we've seen, and attacks upon shipwrecked sailors, clinging to wreckage) cannot be MALUM IN SE. The law is not mere rulemaking, it must be JUSTICE, or it is "NOT LAW", as various Jim Crow and Segregation era rulemaking were determined to have been, for ~ 100 years, after the fact, finally.
That Maritime Drug Law Enforcement Act merely allows firing, after due warnings gave been given, and not to murder people, but to stop fleeing boats, and return fire at those firing upon US vessels. In the intervening decades this has meant a sniper putting rounds through the engines of boats, to stop them. Not missile strikes, that kill all aboard, even upon fleeing boats.
What would this mean in a domestic context? The Police declare, without evidence, that some car is being used to carry drugs - so we use disproportionate force, firing without warning, indiscriminately, to kill even the children in the back seat? I hope that you would object to that, as I would.
Let's also begin by acknowledging that Chuck Shumer is a vile and reprobate War Criminal, many times over. The Trump Administration should be trying to distinguish itself from the low standards which people like Shumer would set.
Look at Tulsi Gabbard, who at one point was speaking out vocally, against this sort of Regime Change activities, and in support of Intelligence Community assessments, that Venezuela is NOT a major drug transshipment point. You want to stop that, look at Ecuador, and Rubio's pal Noboa.
And let's not forget that Rubio himself was LIVING IN a major drug den, with his major Narco trafficking brother-in-law. Perhaps law enforcement should have just dropped a bomb onto the roof of that Mansion, without warning, to kill all within it - without any warrant or warning...🤔
