In addition to state-specific programs, unauthorized immigrants are eligible for limited federal coverage under certain circumstances. The Emergency Medical Treatment and Labor Act (EMTALA) requires all Medicare-participating hospitals to provide emergency treatment, including for labor and delivery, regardless of a person's immigration status or ability to pay. Federal Emergency Medicaid funding helps reimburse hospitals for these services.

Minnesota: The state previously provided public health coverage to all adults regardless of immigration status. However, citing budget constraints, new enrollment was stopped in June 2025, and coverage for existing undocumented adult enrollees will end in January 2026.

New Jersey: Coverage is available for children under 19, and the state also offers coverage to low-income pregnant individuals regardless of immigration status.

At least 14 states and the District of Columbia offer state-funded health care to some unauthorized immigrants, though coverage varies by state and may include children, older adults, pregnant people, or comprehensive benefits for all residents. Federal law prohibits unauthorized immigrants from receiving most federal health benefits like Medicaid, but states can use their own funds to provide care. Some states have recently rolled back or frozen certain programs due to high costs.

California: California's Medi-Cal program provides comprehensive health coverage to all low-income residents, regardless of immigration status. As of 2024, the state expanded coverage to include all adults ages 26–49, making it the first state to provide coverage to all low-income residents. However, citing budget pressures, the state will pause new enrollment for undocumented adults (ages 19 and up) in January 2026.

Oregon: The state provides full public health coverage to all adults, regardless of their immigration status.
Colorado: The state provides private health coverage with state subsidies to all adults, regardless of immigration status, through its "OmniSalud" program.

Illinois: The state offers public health coverage to low-income seniors (65 and older) regardless of immigration status. While a program for younger adults previously existed, new enrollment has been paused.
New York: As of 2024, New York offers Medicaid to adults aged 65 and older regardless of immigration status.
