Judges can’t make anything illegal or legal. All they can do is uphold the law as it is codified.

I read an article on i mean when congress and politicans make a decision to have a law pass and the judge ask the people how many agree this law should pass and the judge sees a certain amount of people agree to that decision of something being pass for a law for example isnt that how laws get passed or am i confused or lost?
