it technically is because you bought either a license to play or a copy of a game, if a game is too similar, then it is in violation of copyright, and if you bought a license to play, you don't have a license for other stuff.

Pirating is stealing. However buying games without owning them isn't really uncommon. Steam for example, if valve wanted to delete your ability to play half life 2, or portal, or TF2, they could, and no one could stop them. However people trust steam, because they don't do that for no reason. But some random game dev might not be considered as trustworthy, so fewer people would buy it
