Ultra instinct can't be copied. The last time who did it almost blew himself up. Heck, when Goku first used it, he almost died because of it.

Also Ultra instinct needs a calm mind, and Metal is 100% not a calm person as show in some of the games where he'll get mad at missing his chance to fight Sonic

And why would eggman even let metal copy BioData anymore? The last time that happened, Metal turned on eggman. and I doubt the scientist would want to go through that again

Metal in his Neo form has proven to be much smarter and more plotting than normal, and hence, much calmer.

Also, in the official comics, Eggman was upgrading Metal into Neo Metal once again so he could be used in the war during Sonic Forces, but he was finished too late to be used. He then went on to take his place after Eggman disappeared.
