It's probably because being a court they KNOW that Israel is not actually meeting the official definition of 'genocide'. It's sort of like how nobody arrested, tried, and convicted of the CRIME of protesting on January 6th inside the United States was tried for actual insurrection, since nothing they did actually met the legal definition of the term.
