The pedestrian has no right of way as pictured and is actually trespassing. They all assume the risk of being run over and have no civil claim for injury. On the other hand, they could be sued for damage to any vehicle or person.
If they are part of any organization or persuaded by any organization (think non-profit community activist group) to be on the highway, that organization could be civilly liable as well.
