For example, two "Oathkeepers'" cases provide possible guidance. Stewart Rhodes and Ray Epps are both members of the Oathkeepers and were involved in the leadership of the march on the Capitol, 1-6-21. Rhodes was found guilty of Seditious Conspiracy for inciting the violence we all saw on TV. Epps encouraged those on site to maintain the peace. He has not been charged. Most of the non-violent protesters' level of involvement was lower than Epps', yet many have been charged.
