So why isn't the new Congress in charge of deciding? That's how they do it in real life.

Because the results of the presidential election are not officially determined until after the new congress comes in. In 2021, the electoral votes were not opened until January 6, 3 days after the new congress would have come in. However, in this stream we have always determined the results the night of, and inaugurated the next day. No new congressmen has ever been given a seat in congress before the president was inaugurated, let alone before the results were announced.

So, if the makeup of that Congress is like you pointed out... 6 to 4... then it only seems logical and fair the party with 6 seats gets to decide...

so this is based off of Article II, section 1 of the US constitution: “if there be more than one who have such Majority, and have an equal Number of Votes, then the House of Representatives shall immediately chuse by Ballot one of them for President.”

It says immediately, so we do it here immediately
