The Constitution is what is says and *only* what it says?
So according to you, there's no constitutional right for women to participate in society in any respect other than to vote? (19th Amendment). This is the only Amendment that makes explicit reference to "sex." Meaning the cribbed view of the Constitution that you suggest would allow a government to ban every other woman's freedom.
Other women's freedoms had to be established through - yes - constitutional interpretation. And I'm not talking just abortion. I'm talking other things we take for granted - to use birth control. To apply for credit. To own property in her own name. To serve on a jury. To hold a job.
Are these broadly recognized modern rights in the 21st Century? Of course they are.
Being strict textualists about the Constitution is simply not feasible. Or we'll be exposing far too much of our lives to the whims of the political process.
