It wasn't that they couldn't prove what Al Capone had been doing - they absolutely could. The two main problems they had was that a lot of it was stuff they didn't actually have laws against because the concept of prosecuting the business management of crime was very new, and that the prohibition of beer was a law that a lot of people including judges didn't want to see enforced in the first place. The reason why Al Capone should have paid his taxes is because that's something judges HAVE to take seriously.
