He was charged with and convicted of bringing a "semi-automatic handgun," a Smith and Wesson (model unknown to me). I have reviewed several new stories to make sure, I was not mistaken. The following line (or a similar one) was in every story I read about his sentencing: "Reffitt was convicted by a DC jury in March of five felonies, including transporting and carrying a firearm on Capitol grounds." This is consistent with the many pictures of him wearing a holster. This is one of several weapons he brought to D.C. in his car.

Seriously, I hope he gets better. It is one thing to dress-up and pretend to be tough. Deluding yourself into thinking that you need to take part in an armed insurrection is "off the charts!" I have worked in a locked mental health facility. People who are forced to take treatment are pretty far gone.

Wierd, how did a guy that did nothing get charged, tried and convicted to 7 years?, I think the law disagrees with you.

In "Shenck vs. the US", Justice Oliver Wendell Holmes made one of his most famous rulings, saying: "The most stringent protection of free speech would not protect a man in falsely shouting fire in a theatre and causing a panic … The question in every case is whether the words are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that Congress has a right to prevent."

Reffitt made specific threats against members of Congress and brought a weapon and supplies to the Capitol, showing an intent to carry them out. He was physically rebuffed in his attempts to gain access to the building. But his attempt to gain access in order to carry out his threats was sufficient for him to relinquish his "Free Speech Rights." That is what the Supreme Court really ruled. Mr. Reffitt can appeal his convictions and see if the courts rule against "Justice AmericanViking."
