Does not matter, he was stupid and deficient in tactics and got shot. Kyle saw a imminent threat to his life and shot it. Feared for his life, end of story. I practiced being a sniper and never once got killed in mock battles. They even accused my of not having my equipment on to register I was dead,. I told them to shoot me and that was the only times as a sniper I showed dead when they accused me off not having my miles equipment on. I hid in Kudzu at night on a side of a hill. Pulling a gun when someone has a gun is suicide. He should have retreated and looked for a place to kill him. But to bad so sad!

Yes, he feared for his life. I testified in a murder trial and thought they would find a friend of mine guilty of at least criminally negligent homicide. He shot an imminent threat because he feared for his life. He was found not guilty. He killed an unarmed man in the guys own front yard. The last words the person said after he stopped choking his wife and came at my friend because he told him to stop was he was going to shove that pistol up his ass. ( I was not there so this is my understanding) I testified to the person killed previously threatening my friend and that the guy was a 101st Soldier and he should fear him since I was a Officer and could make that assessment. Think this would have just went away if he killed Kyle. They would not even went after him in court.

He could of also said if he shot Kyle that he saw him as an imminent threat to others since he saw him shoot 2 people. My friend had a great lawyer. I had about ten items I saw relevant and wrote them on paper. The lawyer told me he wanted me to read off the paper and he did not want me to hand it to him so he did not have to present it to the prosecutor. He wanted me to talk to him with my friend present. The prosecutor ask me ridiculous questions that I think just made the jury go against him more. The prosecutor in this case was very poor and in Kyle's. Still do not think change the out come of not guilty though in either case.
