It depends on what the investigation shows. If the rumors are true that he jokingly pointed the gun at people and pulled the trigger, it might be murder.
That's immaterial. The first thing that anyone that picks up a gun should do is to check to see if it's loaded or not. Even someone saying "It's unloaded" is not good enough and takes no responsibility away in the event of an accident.
