Federal courts ruled that way "the news is entertainment" in the Monsanto / Fox lawsuit way back in 2003 ish somewhere back then. More recently the Rachel Maddow lawsuit for her lying about the Orange dude being a russian agent was finalized. They argued that "no reasonable person would ever believe her", her show is just entertainment. So she got off with no penalties for lying.
