even tho Peter is stronger than Miles.... Miles would be a good idea but since its copyright he cant... but Miles has a lot of abilities that are useful for his moveset. On the other hand, Peter only had web shooters and his strength:/

Well, Spider-Man wasn't originally from Nintendo and he didn't started in a game AND he's also is copyright as well.

So any Marvel characters (DC included) will never have a chance to get into smash. It now depends on the spirits or Dante.

So basically, Miles gets to go to smash.
