I don’t think my own views on this are influencing my prediction of what might or might not happen.
I’ve cited public opinion polls (which have been quite steady on this issue for the past 50 years) as the basis for my theory that a total abortion ban will never happen — solid factual grounding.
I‘ve conceded that smaller restrictions on abortion have happened and can continue to happen.
For Roe v. Wade to be overturned by the states as you suggest, however, the anti-abortion movement would have to clear all the hurdles provided for amending the constitution in that way, including a vote by two-thirds of the states. So, far the “constitutional convention” procedure has never been utilized in the country’s history, though we’ve amended the Constitution 27 times.
Is it possible? Anything’s possible. But highly unlikely 2/3 of our states would do this when the public opinion polls say what they say.
