In some countries, stoning people to death for adultery is legal (and adultury could include being a rape victim), does that mean its not murder?

Well, murder is also a moral term. But admittedly, the definition given by the dictionary uses the word "unlawful" rather than "unjustified", which is an interpretation that is also in common ussage.
