This is actually an amazing insight. I came across a case in my practice where the accused attended a bank, gave the teller a note, asking for money, but actually politely, and with no threat. He was unarmed, and looked down on his luck. Police charged him with robbery, but he was acquitted for the very reason you state here. No threat, no gun, no intimidation and the teller felt sorry for the guy.
