Terms:

“Misuse” is the method of using the characters in a way that is not approved of by the Original Author or not approved by the OC standards. If I believe that my OCs are being used in a way that makes me uncomfortable, or is out of character for the OC, I will flag the post and the post is to be taken down. Characters by Spinel & Company are protected by the terms and conditions as this TAC may be updated at any time to include any new characters or any updated terms and conditions to existing characters. You may use the Original Character as you please as long as it abides the terms and conditions. Creative freedom is great, yet order is encouraged to make good content.

You’re allowed to use the following characters:

You are NOT allowed to use the following characters (reasoning is explained with “[reason here]”):

Chara Dreemurr (In the Style of Spinel & Company, One Piece x Undertale collaboration) [This is a personal character which will not be released to the public to be used until a later confirmed date. Thank you.]

Black Pearl (Hazbin Hotel x Undertale collaboration, Neko variation) [This character hasn’t been released to the public and hasn’t been transferred yet. Thank you.]

Black Pearl (Murder Drones x Undertale collaboration, Drone variation) [This character hasn’t been released to the public and hasn’t been transferred yet. Thank you]

Black Pearl (Hazbin Hotel x Undertale collaboration, Yandere variation) [This is a personal project which is being considered as a public character. Thank you for your patience as we decide the future.]

Conditions (Part 2):

You’re allowed to use our Original Characters as long as:

You don’t use the character in any supportive and antagonistic manner of media, propaganda and it’s subjective materials (ex: anti-corruption, racism, sexism, etc), any way in which the character would be put in a non-consensual sexual situation, hate speech, or any form of biased, supportive, hateful, depreciating, defamatory speech, or any expression of offensive content; the Character is in the Public Use list.

These terms do not apply if the User asks for permission to include any breaching terms in their Content and their permission is granted. Otherwise, the breaching terms stand as is and consequences may follow if the TAC is violated.

Conditions (Part 3):

If the Author deems any Original Characters used in a manner that breaches the Terms and Conditions, it is automatically character misuse and therefore you must remove the offending Content.

Upon agreeing to these Terms and Conditions, you consent to use Spinel & Company’s Original Characters to their rules which can and will change at any time, though terms will be added if necessary, not removed.

I’m basically saying that my OCs will not take part of anything negative or in a way that is going to be used in a harmful manner in which will be further specified when I update my TAC. I also realized that I wasn’t being specific on what isn’t allowed to be part of the Content, so it’s also my fault for not explaining clearly.

I don’t want my characters to be used in any propaganda or any kind of hate or harmful content.

It’s either that you agree to my book when it comes to using MY work, or just don’t use my characters. I’m allowed to go off the grid on the stream definition of character misuse and define my own definition with my own property. I’m not trying to add any official rules here, I’m trying to make a mutual agreement when it comes to using my property and my branding, and I don’t want to be defamed unintentionally by people who can use my character in a malicious or defamatory way. It’s either my way or the highway, and I’m not trying to interfere with the official rules. I’m stating MY opinion on how MY work should be used, and if you don’t like how I’m trying to be as fair as possible and to avoid anything bad, then don’t use my characters.

Im not saying your wrong and as far as I see what your doing is well within the rules. Just know I can’t disapprove an image unless it breaks our preset rules. If you end up with an issue we can work it out.
