Gutfahr, 63, was ultimately sentenced to 10 years in prison, followed by three years of probation, for embezzlement by a public official, money laundering and tax evasion.
She must also pay restitution in its full amount – $38.7 million. She will also be prohibited from making purchases of more than $500, unless approved by her probation officer. And once she has finished paying full restitution, Gutfahr must also pay $13.1 million in taxes.
U.S. District Judge Rosemary Marquez said she had reviewed Gutfahr’s case and found no reason for Gutfahr to have embezzled more than $38 million of public funds during her 10 years in office.
“It wasn’t a one-time thing… It shows a lot of planning, a lot of sophistication,” Marquez said.
