Government has general immunity you'd have to pierce first. You'd have to prove they intended for specific crimes to happen to charge them for it.

Government cannot function without it. Impeachment nd recalls are the proper legal means to deal with most of this.

However when Governor Andrew Cuomo put covid patents in nursing homes, he should have been charged with 1st degree murder. It's not often a dem commits genocide to make the other party look bad, but it happened.
