The Constitution doesn't explicity say that the President isn't above the law, so the matter would have to be decided by the SCOTUS. Hopefully an appropriate amendment will get done when the Dems are back in power.
Didn't SCOTUS already rule 47 can't be held accountable for abuses of power? And what makes you think we'll have fair elections allowing Democrats to win?

i don't think killing innocent Americans was clearly within the scope of their earlier ruling, so they'd need to be more specific. and i didn't say the Dems would regain power by fair elections ( :
