Yeah but it be kind of weird that he was part of the mafia before he became Spider-Man,  also he died before he became Spider-Man then technically as well

no actually! Peter Parker is usually a teenager throughout most of his storyline, so that covers that. Also, it could be a situation where "Hero from a dark background has to fight against his family" type thing.
