so if you kill someone
and you were just intending to knock them out
would that be 2nd or 3rd degree murder (3rd degree is no intention and no plan, 2nd degree is intention but no plan)
i mean you did have intention to harm them
but you didn't have intention to murder them
so what would that fall under

But it would be 3rd degree murder.
1st and 2nd degrees fall under intent to kill.

now what if it was 1st degree but it was hard to tell if it was 1st degree and you said it was 3rd degree

Just keep fighting to convince the judge it was 3rd degree
