If this person, who I don't know or care about, committed a crime, he should be punished accordingly. However, I find it stunning to see the lengths our legal system has gone to to find a punish every single person who "gestured to the crowd" or did anything else. Compare this to the investigation into the 100+ nights of riots that occurred just prior to the capital riot. Where I lived buildings were burned, police cars were burned, people were pulled from their cars and beaten by protesters in the streets, there was looting, etc. Look at the situation in CHAZ. The took part of the city, build a wall around it, burned the police station... there were rape and murders... it lasted weeks... etc.I'm not aware of any follow-up to catch all these other rioters. Why so much focus on hand waving Ryan Kelley?
