LABOUR LAW AND EMPLOYMENT; THE EMPLOYMENT RELATIONSHIP IS LARGELY REGULATED BY THREE MAIN SOURCES OF LAW, THE CONSTITUTION, LABOUR LEGISLATION AND THE LAW OF CONTRACT. AN EMPLOYEE IS ANY PERSON, EXCLUDING AN INDEPENDENT CONTRACTOR, WHO WORKS FOR ANOTHER PERSON OR FOR THE STATE AND WHO RECEIVES, ANY REMUNERATION AND ANY OTHER PERSON WHO IN ANY MANNER ASSISTS IN CARRYING ON OR CONDUCTING THE BUSINESS OF AN EMPLOYER. EMPLOYEES GET PROTECTED BY LABOUR LEGISLATION, WHILE INDEPENDENT CONTRACTORS DON'T.
BASIC CONDITIONS OF EMPLOYMENT ACT 75 OF 1997 SETS MINIMUM TERMS AND CONDITIONS THAT ARE GENERALLY APPLICABLE TO EMPLOYEES. THE MAIN PURPOSE OF THIS ACT IS PROMOTING ECONOMIC DEVELOPMENT AND SOCIAL JUSTICE BY REGULATING THE RIGHT TO FAIR LABOUR PRACTICES.
