Unauthorized possession or mishandling of classified documents is a crime. Period. What you are talking about is mitigating circumstances that might matter during sentencing. For certain Biden for certain is guilty - as a VP he had no authorization to possess those documents and handle them as he did. Trump, as a President, is possibly guilty. The question of what he could do and how he had to do it needs to be resolved.

Go back and take remedial reading. Look up 'possibly'. Just type it in you computer and hit enter. IF indicted, tried and found guilty, Trump should be given a sentence that might include jail time. Since Biden is a sitting President, the only indictment and trial (while he is still President) he could face is impeachment.
