Suing wouldn't work, as it's 1 individual, and it would be a minor offense.
What you should do, is build a sizable base so that if It ever happens again, you'll know and you can track him down.

If there is no evidence, they can't figure it out.
What you should do is see who did your route that day.
Figure that out, and you might have your guy.
