John Kirby won a case for Nintendo, so they named a video character after him. Kirby (the human) was America, so in America, kirby is male. I don't know and don't care what gender he is elsewhere, im America, where I live, he's male. End of discussion.

In this case, it does. In America, kirby is male. He is non binary in Japan, you are right about that, but in America, he's male.

That might be the case in the US, but seeing how that's just a localisation and not the original source material, the point can still be discarded.
