In order for res ipsa loquitur to succeed, the fact that the accident is one that ordinarily does not occur without a failure to exercise due care must be readily apparent to the layperson as common knowledge.

Why would you be relieved if it was a child? You should be feeling as much pity for the child

That's why I taught my kids to stay out of traffic.
