There would be at least 2 concerns, i would think:
1) a surrogate carrying for a male couple could abort at anytime for any reason, and
2) if science someday confirms folks are "born gay" then it would also be reasonable that a genetic test for homosexuality could be in our future, and the "host" could choose to abort for that reason.
